Coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly by person- to-person contact. As a result, federal, state and local governments and federal and state health agencies recommend social distancing and have, in many locations, either prohibited or limited the congregations of groups of people. In addition, the State of California has set certain precautions and limitations in counties, cities, and statewide.

Assumption of Risk: I have read and understood the above warning concerning COVID 19. I hereby choose to accept the risk of contracting COVID 19 for myself and/or children in order to utilize Diablo Football Academy program. To participate in Diablo Football Academy is of such a value to me and/or my children, that I accept the risk of being exposed to, contracting, and/or spreading COVID 19 in order to participate in Diablo Football Academy.

Waiver of Lawsuit/Liability: I hereby forever release and waive my right to bring suit against Diablo Football Academy and its owners, officers, directors, managers, officials, trustees, agents, employees, affiliates or other representatives in connection with exposure, infection, and/or spread of COVID 19 related to utilizing Diablo Football Academy program. I and/or my child or children understand that this waiver means I and/or my child or children give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I and/or my child or children may have to seek damages, whether known or unknown, foreseen or unforeseen.

Agreement to Abide by Safety Protocols: I and/or my child or children agree to fully comply with the safety protocols. I and/or my child or children acknowledge that if, in the sole discretion of Diablo Football Academy representatives, it is determined that I and/or my child or children am not fully complying with the safety protocols, I will be precluded from further participation in Diablo Football Academy.

Notification Requirements: As a condition of the use and participation of Diablo Football Academy I and/or my child or children agree that if I and/or children receive a positive COVID 19 diagnosis, I will promptly notify Diablo Football Academy management. I and/or my child or children consent to allow Diablo Football Academy representatives to notify employees and other users of the program that another user of the program tested positive for COVID 19, without identifying me by name.

By signing this agreement, I acknowledge the following:

The contagious nature of COVID-19 and that I, or my child or children, may be exposed to or infected by COVID-19 by attending any football activities and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I further understand that the risk of becoming exposed to or infected by COVID-19 at any football events/activities may result from the actions, omissions or negligence of myself and others, including, but not limited to Coaches, Referees, Trainers, Volunteers and other participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept the sole responsibility for any injury to myself or my child or children, including but not limited to, personal injury, disability, death, illness, damage, loss, claim, liability or expense of any kind, that I or my child or children may experience or incur in connection with my child or children’s attendance and/or participation in any football activity. On my behalf, and on behalf of my child or children, I hereby release, covenant to sue, discharge, hold harmless Diablo Football Academy and any directors, officers, employees, agents, volunteers and representatives thereof, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence, whether active or passive, of Diablo Football Academy and any directors, officers, employees, agents, volunteers and representatives thereof, whether a COVID-19 infection occurs before, during or after participation in any football activity/event and/or whether an injury occurs during participation in any football activity/event.
